1. Scope and Contracting Party

These General Terms and Conditions ("Terms") apply to all orders placed by customers ("Customer") through the online shop deluxe-sleep.ch with Deluxe Moebel GmbH ("Deluxe Moebel GmbH" or "we"), operator of the online shop deluxe-sleep.ch. By completing an order, the Customer agrees to these Terms. These Terms are available at deluxe-sleep.ch/agb. For questions, our customer service can be reached at info@deluxe-sleep.ch.

2. Prices

All prices stated on deluxe-sleep.ch are in Swiss francs (CHF) and include the applicable value-added tax (VAT/MWST). Costs for delivery, disposal and assembly are not included in the price unless expressly stated otherwise, and are shown separately in accordance with Section 4.

3. Payment Terms

We accept the following payment methods:

- Credit/debit card (Visa, Mastercard, American Express) — processed via Stripe

- TWINT

- Apple Pay and Google Pay — processed via Stripe

- Invoice / advance payment with a Swiss QR-bill: the Customer pays the order using the QR-bill provided; delivery takes place after receipt of payment.

4. Delivery Terms

Deluxe Moebel GmbH delivers within Switzerland and the Principality of Liechtenstein, generally within the stated delivery period. In exceptional cases, delays of up to 2–3 weeks may occur. The delivery period begins once the order has been received with all information required to process it (e.g. colour, orientation).

Standard shipping is free of charge and delivered to the kerbside within Switzerland and the Principality of Liechtenstein. Smaller items (e.g. duvets, pillows, accessories) are shipped by parcel service; larger products are shipped by freight forwarder (Spedition).

For an additional fee starting at CHF 180.00, Deluxe Moebel GmbH offers delivery and assembly into the living space, including removal of packaging material. The price depends on the scope of the service (e.g. CHF 180.00 for a mattress, CHF 300.00 for a bed or box spring bed [Boxspringbett]); the exact price is shown at checkout. This service requires that the goods can be transported through the main entrance; hard-to-reach locations are excluded from this service.

Alternatively, the goods can be collected free of charge from Deluxe Moebel GmbH in Bischofszell by prior appointment.

Delivered goods remain the property of Deluxe Moebel GmbH until the purchase price has been paid in full (retention of title).

5. Acceptance of Delivery

The Customer is notified upon arrival of the goods and undertakes to accept the agreed delivery or collection within the agreed timeframe.

6. Right of Return (14 Days)

The Customer may return ordered goods within 14 days of receipt, provided they are unused and in their original packaging. The return must be announced to Deluxe Moebel GmbH in advance, in writing or by e-mail to info@deluxe-sleep.ch. Return shipping is at the Customer's cost and risk. After receipt and inspection of the returned goods, the purchase price, less the original delivery costs, will be refunded to the original method of payment.

7. 100-Day Core Exchange for Mattresses

For mattresses expressly marked on deluxe-sleep.ch with the "100-Day Core Exchange" feature, the Customer may, within 100 days of delivery, exchange the mattress core for a core of the same model and the same construction height. A service fee of CHF 110.00 applies to the exchange (delivery included); if the chosen replacement core is more expensive, the price difference will be charged in addition. The core exchange applies exclusively to mattresses marked accordingly and does not apply to slatted frames (Lattenroste).

8. Inspection and Notice of Defects

The Customer must inspect the goods upon receipt and notify Deluxe Moebel GmbH of any complaints without delay. If the Customer fails to inspect the goods, to raise a complaint, or to provide evidence of the defect (e.g. photographs), the goods are deemed accepted. Hidden defects remain reserved.

9. Warranty

Goods purchased from Deluxe Moebel GmbH carry a 24-month manufacturer's warranty. Excluded from the warranty are damages caused by wear and tear, aging, or improper use. The right to choose the remedy for warranty claims (repair, replacement, price reduction, or rescission) rests exclusively with Deluxe Moebel GmbH.

10. Governing Law and Jurisdiction

These Terms and all contracts concluded via deluxe-sleep.ch are governed exclusively by substantive Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms or contracts concluded via deluxe-sleep.ch is Bischofszell, Canton of Thurgau, unless mandatory statutory provisions provide otherwise.

11. Interpretation / Language Versions

These Terms are available in German, English, French and Italian. In the event of any contradiction or ambiguity between the language versions, the German version shall always prevail.
